Terms & Conditions

These terms and conditions explain the basis on which Midwife Amie provides website information, appointments, maternity services, antenatal education and related services.

Please read them carefully before making a booking or purchasing a service.

About Midwife Amie

Midwife Amie provides independent midwifery and maternity-related services in Nottinghamshire, Derbyshire and surrounding areas.

In these terms, “I”, “me” and “my” refer to Amie Elliott trading as Midwife Amie. “You” and “your” refer to the person making an enquiry, booking or purchasing a service.

Services

Services may include:

  • Independent midwifery packages

  • Antenatal and postnatal appointments

  • Birth preparation and birth support

  • Single midwifery appointments

  • Antenatal education

  • Non-Invasive Prenatal Testing

  • Home visits

  • Online appointments

  • Discovery calls

  • Other maternity-related support agreed in writing

The exact service, price, location, availability and inclusions will be explained on the relevant service page, during your discovery call or in your individual booking confirmation or service agreement.

 
Professional Registration and Standards

I am a registered midwife and provide services in accordance with the professional standards and requirements that apply to my practice.

I will provide care with reasonable skill and care, using professional judgement and current evidence-based guidance.

No healthcare professional can guarantee a particular pregnancy, birth, test or health outcome.

 
Making an Enquiry

Submitting an enquiry or booking a discovery call does not create a contract and does not guarantee that I will be available to provide your care.

A discovery call gives us an opportunity to discuss your requirements, location, expected due date and whether my services may be suitable.

I reserve the right to decline a booking where:

  • I do not have suitable availability

  • You are outside my service area

  • The service requested is outside my professional scope

  • I believe another service or healthcare professional would be more appropriate

  • I cannot safely or reasonably meet your care requirements

  • A safe and professional working relationship cannot be established

Where possible, I may suggest another appropriate service or source of support.

 
When a Contract Is Formed

A contract is formed when:

  • We have agreed which service will be provided

  • You have received confirmation of the booking

  • You have accepted any service-specific agreement provided to you

  • Any required deposit or payment has been received

Your booking is not secured until these steps have been completed.

For ongoing maternity or birth packages, additional terms may be included in your individual service agreement. If there is a conflict between these general terms and your signed service agreement, the service agreement will apply to the relevant service.

 
Prices

Prices will be shown on the website, provided during an enquiry or confirmed in writing before you book.

I will not increase the agreed price after a contract has been formed unless:

  • You request additional services

  • The scope of the service changes

  • Additional travel or other costs are agreed with you in advance

  • The contract expressly allows a reasonable change in defined circumstances

Any additional costs will be explained and agreed before they are charged.

 
Deposits and Payment Plans

For maternity care packages, a 25% deposit is normally required to secure your booking.

Flexible payment plans may be available for certain packages. The payment schedule will be agreed in writing before your care begins.

Unless otherwise agreed, maternity care packages must be paid in full by 36 weeks of pregnancy.

Deposits and advance payments are not automatically non-refundable. If you cancel, any amount retained will be reasonable and will reflect services already provided, costs already incurred and losses directly resulting from the cancellation.

Payments for single appointments, tests or classes may be required in full when booking.

 
Missed or Late Payments

Payments must be made by the dates shown in your invoice, booking confirmation or payment plan.

If payment is late, I will contact you and give you a reasonable opportunity to make the payment.

I may pause non-urgent services or cancel future appointments if payment remains outstanding. I will not withdraw urgent clinical care in a way that would place you or your baby at avoidable risk.

You remain responsible for paying for services already provided and reasonable costs already incurred.

 
Your Right to Cancel

If you enter into a service contract online, by telephone or in your home, you will normally have a legal right to cancel within 14 days of the contract being formed.

To cancel, email amie@midwifeamie.com and clearly state that you wish to cancel the service.

If you ask me to begin providing services during the 14-day cancellation period, you may be required to pay a reasonable amount for the services provided before you cancelled.

If the service has been fully provided during the cancellation period after you expressly requested an early start and acknowledged that your right to cancel would be lost once the service was completed, your cancellation right may no longer apply.

Nothing in these terms affects your statutory consumer rights.

 
Cancellations After the Cooling-Off Period

If you cancel after the 14-day cooling-off period, the amount refunded will depend on:

  • The services already provided

  • The time reserved for your care

  • Work already undertaken

  • Costs already incurred

  • How much notice you provide

  • Whether I can reasonably offer the reserved time to another client

  • The terms of any individual service agreement

I will take reasonable steps to reduce any losses caused by the cancellation.

I will not retain payments or charge cancellation fees that are disproportionate to my reasonable direct losses.

Any refund due will be explained and processed within a reasonable period.

 
Cancelling or Rescheduling an Appointment

If you need to cancel or reschedule an appointment, please contact me as soon as possible.

Where reasonable notice is given, I will try to arrange another appointment, subject to availability.

If you cancel at short notice or do not attend, you may be charged for time reserved and reasonable costs incurred. The amount charged will depend on the circumstances and any cancellation terms provided when you booked.

I understand that pregnancy, birth and family life can be unpredictable. Where an appointment is missed because of an emergency or exceptional circumstances, please contact me so the situation can be considered fairly.

 
If I Need to Cancel or Reschedule

Midwifery work is unpredictable. I may occasionally need to delay or reschedule a routine appointment because I am attending a birth, responding to an urgent clinical situation, am unwell or am affected by circumstances outside my reasonable control.

If this happens, I will contact you as soon as reasonably possible and offer:

  • A rearranged appointment

  • An appropriate alternative, where available

  • A refund for the affected service where it cannot reasonably be rearranged or provided

I am not responsible for losses that could not reasonably have been anticipated when the contract was formed. This does not limit your statutory rights or my responsibility for losses caused by my negligence where liability cannot legally be excluded.

 
Birth Support and On-Call Services

Pregnancy and birth are unpredictable. Estimated due dates and expected care plans may change.

Where birth support or on-call care is included, the specific on-call period, contact arrangements, coverage, backup arrangements and any limitations will be set out in your individual service agreement.

Although I will take reasonable steps to provide the agreed support, attendance at a particular time or location cannot be guaranteed where circumstances outside my reasonable control prevent it. These may include:

  • Sudden illness or injury

  • Another clinical emergency

  • Unsafe travel conditions

  • Hospital restrictions

  • Events outside my control

  • Circumstances in which attending would be unsafe or professionally inappropriate

Your individual agreement will explain what will happen if I am unable to provide part of the agreed birth support.

 
NHS and Other Healthcare Services

Independent midwifery care does not automatically replace all NHS maternity, medical or emergency services.

Depending on your circumstances, you may still need to:

  • Register for NHS maternity care

  • Attend NHS scans, tests or consultant appointments

  • Access hospital or specialist services

  • Contact your GP, NHS maternity unit or emergency services

  • Follow advice provided by an appropriate healthcare professional

I may work alongside NHS professionals and services where appropriate, but I do not control their decisions, availability, policies or actions.

I am not responsible for the acts or omissions of an NHS trust, hospital, laboratory, GP practice or other independent healthcare provider.

 
Emergencies and Urgent Medical Concerns

The website, email, social media and routine booking system must not be used for emergencies.

If you or your baby may require urgent medical attention, contact your NHS maternity unit, call NHS 111, call 999 or attend the appropriate emergency service.

Messages and emails are not continuously monitored, including outside my stated working or on-call hours.

Where you have purchased an on-call care package, use the contact arrangements provided in your individual service agreement.

 
Your Responsibilities

To help me provide safe and appropriate care, you agree to:

  • Provide information that is accurate, complete and up to date

  • Tell me about relevant medical conditions, symptoms, medication, test results and changes to your pregnancy

  • Attend agreed appointments or give as much notice as possible when you cannot attend

  • Follow emergency and escalation advice where appropriate

  • Treat me and anyone working with me respectfully

  • Provide a reasonably safe environment for home visits

  • Tell me about hazards, illness, animals, smoking or other circumstances that may affect a home visit

  • Pay agreed fees by the due dates

  • Ask questions if anything is unclear

I am not responsible for consequences caused by information being withheld or by information that is materially inaccurate, except where I should reasonably have identified the issue through professional care.

 
Home Visits

You are responsible for providing accurate directions, access information and parking details where relevant.

I may leave, postpone or decline a home visit if I reasonably believe the environment is unsafe. This may include threatening behaviour, uncontrolled animals, unsafe smoking conditions, illegal activity or another serious risk.

Where possible, I will discuss an alternative way to provide the service.

Additional travel charges will only apply where they have been explained and agreed in advance.

 
Online Appointments

You are responsible for having a suitable device, internet connection and private environment for an online appointment.

Although reasonable steps will be taken to protect confidentiality, no online communication system can be guaranteed to be completely secure.

If technical problems prevent an appointment from taking place, we will try to reconnect or rearrange it. Refunds or rescheduling will be considered according to which party’s systems caused the problem and whether the service could still reasonably be provided.

 
NIPT and Other Tests

Non-Invasive Prenatal Testing is a screening test, not a diagnostic test. A high-chance or inconclusive result does not confirm that a baby has a particular condition, and a low-chance result cannot rule out every condition or pregnancy complication.

The conditions screened for, limitations, possible results, laboratory process, expected timescales and available next steps will be explained before testing.

You are responsible for providing accurate pregnancy and medical information relevant to the test.

Samples may be processed by an external accredited laboratory. Laboratory timescales are estimates and may be affected by circumstances outside my control.

Occasionally:

  • A sample may not produce a result

  • A repeat blood sample may be recommended

  • Results may take longer than expected

  • Further diagnostic testing or specialist advice may be recommended

Any arrangements and charges relating to repeat samples will be explained as part of the specific NIPT service before you proceed.

Testing cannot guarantee a particular pregnancy or health outcome.

 
Antenatal Education

Antenatal education provides general and personalised information to help you understand pregnancy, birth, postnatal recovery and your available choices.

It does not replace individual medical assessment, diagnosis or emergency care.

Information is based on the circumstances and evidence available at the time. Maternity guidance and individual circumstances can change, so you should seek appropriate clinical advice where necessary.

 
Communication and Availability

My usual working hours are:

Monday to Friday: 9am to 5pm
Saturday and Sunday: Appointments only

Routine emails, messages and enquiries will be answered as soon as reasonably possible during working hours.

Unless included in an agreed care package, booking a service does not provide unlimited or 24-hour access to me.

Communication and on-call arrangements included in a maternity package will be explained in your individual service agreement.

Confidentiality and Personal Information

Personal and health information will be handled confidentially and in accordance with applicable data protection law and professional requirements.

There are limited circumstances in which information may need to be shared without your consent, including:

  • A medical emergency

  • A serious safeguarding concern

  • A legal or regulatory requirement

  • A court order

  • A situation involving a serious risk of harm

Complaints

If you are unhappy with a service, please contact me as soon as possible so I have an opportunity to understand the issue and try to resolve it.

Email complaints to amie@midwifeamie.com.

I will acknowledge a data protection complaint within 30 days and investigate it without undue delay. Other service complaints will be acknowledged and addressed as soon as reasonably possible.

Making a complaint does not affect your statutory rights or your right to raise a concern with an appropriate regulator or professional body.

Nothing in these terms excludes or limits liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to this:

  • I am not responsible for losses that were not reasonably foreseeable when the contract was formed

  • I am not responsible for losses caused by inaccurate or incomplete information supplied by you

  • I am not responsible for the actions or omissions of independent third parties, laboratories, hospitals or NHS services

  • I do not guarantee a particular pregnancy, birth, test or health outcome

  • I am not responsible for business losses where you purchase services wholly for personal purposes

Your statutory rights are not affected.

 
Events Outside My Control

I am not responsible for delays or failure to provide a service caused by events outside my reasonable control.

These may include severe weather, travel disruption, illness, public-health restrictions, power or internet failure, hospital restrictions, emergency clinical work or other unforeseen events.

I will contact you as soon as reasonably possible and take reasonable steps to minimise the effect on your care.

 
Changes to These Terms

I may update these terms to reflect changes to my services, working practices or legal responsibilities.

The terms that apply to your booking will normally be those in force when your contract is formed, together with any individual service agreement.

Changes will not remove rights you have already acquired under an existing contract.

 
Governing Law

These terms are governed by the laws of England and Wales.

You can bring legal proceedings in the courts of England and Wales. If you live in another part of the United Kingdom, you may also have the right to bring proceedings in your local courts.
